The EB-5 visa lets foreign investors get U.S. permanent residency by investing money in the country. It provides a green card for the investor, their spouse, and children under 21, allowing them to live and work in the U.S.

There three main requirements–
  • Make a capital investment in a U.S. New Commercial Enterprise (NCE) of either $800,000 or $1.05m depending on the location of the business that you are investing in.
  • EB-5 investment must lead to the creation of 10 full-time U.S. jobs for at least a two-year period.
  • EB-5 investments must also be made in an approved business entity.

Yes. Once the form for EB-5 (I-526 petition) is filed and approved, an applicant can change his/her visa status to EB-5.

There are three main checkpoints, all with their own timeline:

  • EAD: Typically issued within 6-8 months of filing, allowing an investor to work in the U.S.
  • Temporary Green Card: Granted approximately 2-3 years after investment, providing conditional permanent residency.
  • Green Card: After 2+ years of conditional status, you can apply to remove conditions and obtain a permanent green card.

“Targeted Employment Area (TEA)” is a rural area with a high rate of unemployment. Any other area that is not designated as a high rate of unemployment area is called “non-TEA.”

It's best to pay the full amount before sending in the I-526E form. But sometimes, regional centers or lawyers might let you pay part of it if you can show you’re working on getting the rest of the money. You’ll need extra papers to show how you’ll pay the rest and where the money is coming from. If you take too long to pay, it could hurt your chances of getting the I-526E form approved.
